Welcome to SafeRadar AI. These Terms of Service ("Terms") govern your use of the SafeRadar AI Shopify application (the "Service") provided by Radtly sp. z o.o. ("we", "us", or "our"), a company registered in Poland.

1. Acceptance of Terms

By accessing and using SafeRadar AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service following notice of changes constitutes your acceptance of the modified Terms.

2. Service Description

SafeRadar AI is a Shopify application ("App") designed to assist merchants in complying with EU consumer protection regulations, including but not limited to:

• EU Consumer Rights Directive (2011/83/EU) – 14-day withdrawal rights management
• GDPR (General Data Protection Regulation) data compliance
• Automated withdrawal registration and confirmation templates

The Service is provided as-is and operates on a subscription basis. Specific features and pricing are as detailed in your subscription via the Shopify App Store.

2.1 AI-assisted features

SafeRadar AI provides AI-powered capabilities, including AI Summary for dashboard insights and an AI Chat Assistant for merchant support. These features utilize advanced language models to process store data and provide automated assistance based on your request activity and compliance status.

Output from these features is informational only and does not constitute legal, tax, or compliance advice. You remain solely responsible for reviewing the underlying data, making business decisions, and ensuring that your store complies with all applicable laws. AI-generated content may be incomplete, delayed, or inaccurate and should not be relied upon as the sole basis for action.

3. Eligibility

You must be at least 18 years old and a legal entity (individual or business) authorized to enter into binding agreements to use SafeRadar. By installing and using the App, you represent and warrant that you are authorized to bind your Shopify store and business to these Terms.

You must maintain a valid Shopify store and comply with Shopify's Terms of Service. Any use of SafeRadar that violates Shopify's policies is strictly prohibited.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Keep your login credentials secure and confidential
• Promptly notify SafeRadar of any unauthorized access or use of your account
• Ensure that all information provided is accurate and current
• Review your account activity regularly

SafeRadar is not liable for any unauthorized use of your account caused by your failure to maintain account security.

5. Intellectual Property Rights

All content, functionality, and materials within SafeRadar (including but not limited to software, code, design, documentation, and text) are the exclusive property of SafeRadar or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes.

You may not:

• Reproduce, modify, or distribute any part of the Service
• Attempt to reverse-engineer or decompile the software
• Remove or alter any proprietary notices or labels
• Use the Service for competitive purposes or to develop competing services

6. Acceptable Use Policy

You agree not to use SafeRadar for any unlawful purpose or in any way that violates these Terms or applicable laws. Prohibited activities include, but are not limited to:

• Harassment, abuse, or threats directed at SafeRadar staff or other users
• Unauthorized access or attempts to breach service security
• Sending spam or malicious code through the Service
• Impersonating others or misrepresenting your identity
• Using the Service to sell illegal goods or services
• Circumventing or disabling any security or safety features
• Uploading or transmitting viruses or malicious content

SafeRadar reserves the right to immediately suspend or terminate your account if you violate this policy.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• SafeRadar and its suppliers are not liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the Service, including but not limited to lost profits, data loss, or business interruption.
• The total aggregate liability of SafeRadar shall not exceed the fees paid by you in the 12 months preceding the claim.
• SafeRadar does not warrant that the Service is error-free, uninterrupted, or suitable for any particular purpose.
• You use the Service at your own risk. SafeRadar is provided "as is" without warranties of any kind.

While SafeRadar strives to assist with EU regulatory compliance, we do not guarantee that use of SafeRadar will ensure full legal compliance with all applicable laws. You remain responsible for ensuring your business operations comply with all relevant regulations.

Any AI-assisted summary or recommendation is provided for convenience only. SafeRadar does not warrant that AI-generated content is accurate, complete, or suitable for any particular decision or legal purpose.

8. Termination

You may terminate your subscription to SafeRadar at any time by uninstalling the App from your Shopify store. Upon termination:

• Your access to the Service will cease immediately
• SafeRadar may retain your data in accordance with its Privacy Policy and applicable law
• You remain responsible for any charges incurred prior to termination

SafeRadar may terminate or suspend your account immediately if you violate these Terms or engage in unlawful activity. Termination by SafeRadar does not require advance notice if the violation is severe.

9. Modifications to Terms

SafeRadar may modify these Terms at any time. Material changes will be communicated via email or by displaying a prominent notice when you next access the Service. Your continued use of the Service after such notice constitutes your acceptance of the modified Terms.

If you do not agree with any modifications, you must discontinue use of the Service.
